Building a mosque on the second floor with shops on the first

Question

A/A Is it permissible to build a mosque on shops i.e, ist floor shops and mosque on 2nd floor.

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

There is no objection to building a mosque on the second floor and building shops below it, and it is also permissible to build a building of several floors and use one or some of them for the mosque and some of them for specific purposes – like conference rooms, and the like – while reserving the lowest floor for shops.

A Fatwa of the Permanent Committee of Iftaa reads: “It is permissible to assign the floor under the mosque for shops for rent whose rental money would be used for the needs of the mosque.

The Committee was also asked about whether it is permissible for someone to build a mosque on his land on the second floor and two flats, one for the Imaam and one for the Mu'aththin, while the first floor will be for shops. The answer is as follows: “There is no objection to building the mosque on the second floor, and making the ground floor as shops whose profit would be for the donor, and making the third floor a housing for the Imaam and the Mu'aththin; because the intention of the donor is to build the mosque according to this mentioned arrangement … may Allaah reward the donor with the best reward, and make this in his scales of good deeds on the Day he meets Him.
